"Puma" Wenzhou Encountered "Li Gui"
In July of this year, Rudolf Darth sporting goods Co., Ltd. (Germany) (hereinafter referred to as the German wave company) found that the "Puma" series of trademarks encountered multiple "Li Gui" in Wenzhou. The more than 10 supermarkets in Yongjia County Ren Le Le supermarket limited and Ruian Silver City Supermarket Co., Ltd. were selling the "leopard" graphic trademarks and similar shoes and knucksack products, and they brought the supermarkets to court. The total amount of claims was 1 million 600 thousand yuan.
Yesterday morning, the Wenzhou intermediate people's Court opened a case of "jumping leopard" (Puma) trademark infringement dispute.
After the trial, the court held that the "Bake" sports shoes sold by Yingcheng supermarket were similar to those approved by the German registered trademark of the company, and the logo of the sports shoes was basically the same as that of the "leopard" registered trademark.
Although the "leopard" pattern on this kind of sports shoes is used as the decoration of products, it still constitutes infringement.
The court decided in court to sell the infringing product of Ruian Silver City supermarket limited to compensate the German company for 55000 yuan.
The judge told reporters that after the prosecution of the company in Germany, 9 supermarkets have been reconciled with their private counterparts, 3 cases have been pronounced in court, and another 2 cases will be held in court recently.
